Successfully Raise A Defence Of Necessity Necessity and Private Defence are closely linked therefore; many of the requirements of private defence are also requirements for necessity. The difference between these two grounds of justification is that private defence stems from and is directed at, an unlawful human attack while in necessity a person finds him/herself in a situation in which he/she must between two evils: either suffer personal harm or break the law. The act of defence in private defence is always directed at an unlawful human attack whereas; in cases of necessity it is directed at either the interests of another innocent party or a mere legal provision. (Snyman, 2008, p. 115) Necessity There must be an urgent and immediate threat to life which creates a situation in which the defendant reasonably believes that a fair response to that threat is to break the law. This reflects the distinction between the defenses of necessity and duress in that the former is pressure of circumstances arising naturally, whereas the latter is a threat from an entirely human agency that overpowers the will of the defendant. The subjective frame of mind of the person who is relying on necessity the courts will not consider this but rather whether the act of necessity was in accordance with the legal conviction of society. The courts will also weight the option of whether a reasonable would have acted in the same way as a person that claims to have acted in necessity. They are using the concept of the reasonable person to practically embody the legal convictions of society and not to determining negligence. (Joubert, 2001, p. 61) REQUIREMENTS TO SUCCESSFULLY RAISE A DEFENCE OF NECESSITY The author will no discuss five (5) requirements that must be met in order for a person to successfully raise a defence of necessity: A legal interest must be endangered The danger must have begun or be imminent The defensive act must be necessary to avert the danger The defensive act must be reasonable The endangered person must know he/she is acting in necessity A legal interest must be endangered The purpose of the specific conduct must be clearly to protect a legal interest. Although the law recognizes many interests the most obvious are a persons life, limb, personal safety and integrity. A person may act in a situation of necessity to protect property but cannot relay on necessity to protect his/her job. If a person is not able to perform his job without breaking the law he must find another way to earn a living. For example a person cannot operate an illegal shebeen and claim it is to sustain his family when apprehended. The person must rather apply legally for a shebeens license. A person may also act in necessity in defence of some else. (S v Pretorius, 1975) The danger must have begun or be imminent When danger has already passed or will possibly occur in the distant feature a person cannot rely on necessity. Therefore, the danger must already have begun or the situation must be immediately threatening. In the trail Regina v. Dudley Stephens four stranded sailors were adrift in a small boat without supplies. The three strongest decided to eat the fourth, a seventeen (17) year old cabin boy to save themselves. There was some degree of necessity arising from the threat of starvation, even though the cabin boy would almost certainly have died of natural causes the sailors killed the boy intentionally and the court ruled that cannibalizing the boy was not urgently necessary and found them guilty of murder. (Regina v. Dudley Stephens, 1884) The defensive act must be necessary to avert the danger When a person relies on necessity the action taken should have to avert the danger. When there is less drastic measure to avert the danger a person a person should take this option. If it was not taken a person cannot rely on necessity. For instance when a man are awake by a noise in the middle of the night and found a person at his fridge busy eating food and killed the person by shooting him he thus cannot relay on necessity. If there is a possibility that a person can flee from the immediate or imminent danger he should do so. (S v Pretorius, 1975). The danger does not take the form of an unlawful attack and removing oneself from the danger in most cases of necessity. The defensive act must be reasonable A person must act reasonable if he wants to rely on necessity as ground of justification. The interest that is being protected must not be disproportionate of the defence act. Not more harm than is necessary to avert the attack must be inflicted by the person who wants to rely on necessity. According to Snyman this proportionality requirement is sometimes explained by requiring that the protected interest should be of greater value than the interest that is infringed upon. (Snyman, 2008, p. 119). The protected and infringed interests are a totally different nature, but if the infringed interest is a legal provision only, the defence of necessity would most probably succeed. For example a correctional exceeding the speed limit because he is rushing to the Prison where inmates are in the process of escaping, he will most probably be allowed to justify his actions by relying on necessity as a defence, since he infringed a legal provision only. The endangered person must know he/she is acting in necessity If a person is conscious of the fact that an emergency exists and knowingly acted in necessity than he can rely on necessity as a defence. A person cannot thus rely on necessity as a ground of justification if he throws a brick through a window in an attempt to break into a house but his action saves the occupants lives who are sleeping in a room filled with poisonous gas. PRIVATE DEFENCE The onus is on the state to prove beyond reasonable doubt that the accused action cannot be justified, if private defence is raised as a ground of justification. Private defence involves a person who takes the law into his own hands. Therefore, it is a drastic measure that should not be used for corrective purposes. Snyman alleged that this ground of justification has no history, but exist from the beginning of time. (Snyman, 2008, p. 103). Every person has a right to defend himself against an unlawful attack a right that is recognised in section 51 of the Charter of the United Nations. The two theories for the existence of private defence are protection theory, which emphasises each persons right to defend oneself or another against an unlawful attack whereas in upholding-of justice theory is where people acting in private defence perform acts assist in upholding the legal order. (Snyman, Criminal Law, 2004, p. 178). It is the primary duty of the state to protect the life and property of individuals but no state no matter how big its recourses can afford it. Therefore, this right has been given by the state to every citizen to take the law into his own hands for their safety. REQUIREMENTS TO SUCCESSFULLY RELIANCE ON PRIVATE DEFENCE The requirements of private defence can be divided into two groups for the purpose of classification namely: the requirements with which the attack must comply and the requirements with which the defence must comply. Requirements of the attack It must be unlawful A legal interest deserves protection. It must be imminent, but not yet completed The attack must be unlawful When the attack on a person is unlawful only than can a defender rely on private defence. A suspect who was lawfully arrested by a police official cannot rely on private defence in resisting the arrest. On the other hand, when a police official exceeds his powers by arresting a person he is not allowed to arrest the person may resist and can rely on private defence to justify his resistance. A legal interest deserves protection. Normally a person acts in private defence to protect his life, limb, bodily integrity and property. These are not the only interest worth of protection as the courts also recognized a persons right to defend personal freedom, sexual integrity, self-respect and chastity. To protect the interest of other persons is also an act of private defence but than the third party should want the defender to act on his behalf. However, the defender will not be able to rely on private defence if the victim does not want the help of the defender. (Joubert, 2001, p. 52) The attack must be imminent, but not yet completed If it is clear that an attack is about to happen than a person can rely on private defence. The defender doesnt have to wait for the attacker to attack first if the attack is imminent he can avert the attack by defending himself before the attack actually arise. But if the attack have been already completed the defender no longer defend him but get even. In the case of S v Moghlwane it was find that if the attack formed part of one and the same immediate and continued act of resistance, the defender can rely on private defence even if he left the scene temporarily. (S v Mogohlwane, 1982) The defence requirements Before private defence can succeed the defensive action have to comply with certain standards. The defence must be directed at the attacker It must be necessary It must be reasonable The defence must be directed at the attacker When the defence is directed at anyone else than private defence as a ground of justification will not succeed therefore, it may only be directed at the attacker. (Snyman, Criminal Law, 2004) The defence must be necessary If there is another way that the attack can be averted in a less serious way than that option should be used. The law must not be taken into their own hands if the defender can rely on another remedy. Therefore, the defence should be absolutely necessary in order to protect the interest threatened. The question arises than should a person rather flee an attack than resort to private defence? But than once there is a duty to flee it will imply that justice will have to give up to injustice. Therefore, it is not expected of a police official on duty to flee if he is being attacked while lawfully performing his duties. The defence must be reasonable There should be a balance between the attack and the defence. The defence act may not be more harmful than necessary to ward of the attack. Therefore, it would be unreasonable to kill a person who attempts to steal bread. Proportionality also plays a very important role in determining whether the defence was reasonable or not. The proportionality requirement will be met if the defence act is reasonably proportionate to the attack. The right of private defence is a good weapon in the hand of citizens to defend themselves but it is not revenge rather towards the threat and imminent danger of an attack. The courts find it difficult whether this right had been exercised in good faith or not. Conclusion It can be said that the confusion arise between Necessity and private defence are that they are closely related to each other. The difference are than is that private defence is an act of defence directed at an unlawful human attack while necessity is directed at either the interests of another innocent party or a simple legal provision.

The Effects of Underage Drinking on the Brain Corey Negin, Devin Glim, Aman Gill, Helen Marzec, Kimberly Dias Keywords: Alcohol, Brain, Development, Hippocampus, Frontal areas, Cerebellum, Neuroplasticity, Addiction, Deleterious behaviour and Chronic consumption. Rational/Goal: This video will fixate on alcohol, but will explore the effects of underage drinking on the brain, targeted to teenagers. Underage drinking is widespread as adolescents undergo stressful developmental transitional periods rendering them vulnerable to alcohol consumption. Research indicates that adolescents consume a lot of their alcohol intake by binge drinking, which has detrimental effects upon brain development, as brain maturity and refinement is not finalized until an individual reaches their mid-twenties. Subsequently, the brain development compromised by chronic alcohol consumption can promote deleterious behaviours that persist into adulthood and future functioning. Description/Summary: We will first describe the regions in the brain affected by alcohol consumption. Early in development, the brain creates as many synaptic connections as possible. However, development then shifts to creating efficient neural pathways. Our video will delve into the heightened neuroplasticity that occurs within adolescence. This is a duration by which the prefrontal cortex undergoes myelination and extensive synaptic pruning. The prefrontal cortex governs decision-making and concentration. However, periods of binge drinking have been shown to cause significant white matter loss and myelin damage within the prefrontal cortex. Our video will describe the importance of myelination and how myelin sheath aids in increasing nerve impulse speed. Thereafter, we will denote that a compromise within the nerves ability to conduct impulses would result in cognitive impairment. We will then continue onto the structural and functional changes that the hippocampus incurs due to u nderage drinking; specifically, an increase in immature dendritic spines whereby the branches off the nerve cells appear long and thin. The hippocampus is crucial for learning and memory. This therefore cultivates alcohol-induced memory deficits. Furthermore, the altered brain functioning appears to be irreversible. Additional evidence exhibits a thinner prefrontal cortex and smaller hippocampus within adolescent drinking individuals, relative to the age the alcohol consumption began. Describe brain regions affected by alcohol consumption (eg. prefrontal cortex, hippocampus, cerebellum) [Both structural functional changes) Hippocampus: learning memory (learning new information would become difficult; transfer from short term to long term memory [propagating blackouts]) -Kim- 30secs Many regions of the brain, including the hippocampus and prefrontal cortex, are actively developing throughout ones adolescence, and are therefore more susceptible to damage due to alcohol consumption. The hippocampus is a small part of your brain that processes and stores memories. Drinking excessive alcohol can affects ones ability to form new memories, and hold on to new information. This is because alcohol can impair your brains ability to transfer new learned information from your short term to your long term memory (Hiller-Sturmhà ¶fel, Swartzwelder, 2004). As a result, you may be able to remember whats happening in the moment during a night of drinking, but may find it hard to recall the events that occurred that night the following day. Alcohol can also affect your ability to form new explicit memories, which are memories of facts such as names and phone numbers, or events, like what you did last night. Excessive drinking can cause excessive damage to the hippocampus, resul ting in blackouts: periods of time that you cannot remember what happened at all. (Anderson et al., 2009). Finally, studies have shown a correlation between excessive drinking and a decrease in hippocampus size in the brain. (Debellis et al., 2000). Frontal areas: impulses, thinking through consequences (poor decision making, lack of self control)- Aman -30secsAs soon as we take that shot of vodka, one of the first parts of the brain the alcohol will affect is the frontal lobe, specifically the prefrontal cortex. The prefrontal cortex involves planning complex cognitive behaviour, attention, and decision making (Abernathy, Chandler, Woodward, 2010). Therefore, it should come to no surprise that alcohols profound effects on the prefrontal cortex, ultimately impair our ability to make rational decisions, as well as our reasoning and judgement! In fact, George, Rogers Duka, conducted a study among social drinkers to assess the decisions they made through various gambling tasks. They concluded that acute alcohol intake lead them to make significantly more risky decisions (George, Rogers, Duka, 2005). To add, another study conducted on the effects of adolescent binge drinking and decision making showed a high association between r elatively more disadvantageous decisions and those who started binge drinking at an early age (Goudriaan, Grekin, Sher, 2007). So how exactly does alcohol lead us to tell our crush how obsessed we are with them? The prefrontal cortex inhibits cortical and subcortical structures, which help prevent us from the urges to say something socially unacceptable (Munakata et al., 2011). Alcohol affects the NMDA glutamate receptors by inhibiting these same inhibitory effects of the prefrontal cortex, essentially making us disinhibited (Tu et al., 2007)! Cerebellum: motor control (balance; difficulties standing or walking)- Devin 20secsAlong with the hippocampus and frontal areas, the cerebellum may also be affected by heavy adolescent alcohol consumption. The cerebellums main functions are to control motor function while also participating in cognitive learning related to spatial awareness (Doya, 2000). This is why we have difficulties walking, standing, or even preventing our drink from accidentally spilling on our crush as we tell them how much we like them! Unfortunately, these difficulties can become long-lasting as alcohol can change the biochemical function of the cerebellum (Ward et al., 2009). Microglia levels (the brains immune cells) also increase in response to alcohol exposure, resulting in an increase in the inflammation of the surrounding brain tissue, leading to eventual long term neuronal death (Riikonen et al., 2002) 2. Heightened neuroplasticity that occurs during adolescent brain development (myelination, synaptic pruning; see letter of intent for more)- 30secs 3. The brain isnt fully developed until 25 years old thereby critical development is interrupted [Explain the long term lasting consequences]- 30secs Adolescence is a time between childhood and adulthood whereby neural development is composed by physical, psychological and social changes marking this a period of vulnerability and adjustment (Bourque et al., 2016). It also marks a time of increased emotional reactivity and sensitivity which contributes to a greater degree of addiction during the developmental period (Bourque et al., 2016; Case, Jones, Hare, 2008). Indeed, neuroplasticity, the ability to form new neural connections, is influenced by the environment, and particularly within adolescence when the brain is still within development (Hiller-Sturmhà ¶fel Swartzwelder, 2004). The cognitive development that occurs during adolescence is linked to greater cognitive control and modulation whereby increased activation in the prefrontal regions is indicative of maturity (Bourque et al., 2016; Case, Jones, Hare, 2008). However, adolescents indulge in deleterious and high-risk behaviour such as binge drinking which significant ly impair the neuroplasticity of the brain, involving the myelination of the prefrontal fiber tracts (Clark, Thatcher, Tapert, 2008). As a result, binge drinking can start to develop, which is the consumption of excess amounts of alcohol in a short period of time. Binge drinking can lead to many structural and functional changes such as difficulty walking, blurred vision, slurred speech, slowed reaction times and impaired memory. It is important to note that maturational changes in brain anatomy, connectivity, and function continue well into late adolescence. To date, imaging studies using different modalities have consistently reported that alcohol use during adolescence is associated with abnormalities in brain structure, function and connectivity. Furthermore, the altered brain functioning appears to be irreversible. Additional evidence exhibits a thinner prefrontal cortex and smaller hippocampus within adolescent drinking individuals, relat ive to the age the alcohol consumption began.So is it really worth it? Essay --

Literature is our ancient form of a hard drive where we can read something from the past and connect with our present. The more we read, the more literate we become. Therefore, we have the opportunity to open our minds to more ideas and try to understand the way other human beings think. From the beginning of time human beings have developed methods to communicate with each other. Our ability to develop these methods have allowed us to pass our knowledge from one generation to another. This development has given us the opportunity to expand our knowledge to higher standards. Literate work is beneficial to all of us by allowing us to understand others way of thinking, the ability to analyze characters, learn about the authors experiences and stimulate our mind. Literature gives us an insight of what other people think, feel, know, understand and gives us a glimpse of their past to name a few. In â€Å"Fences† by August Wilson, we learn how African American people have struggled to have equality. Wilson is able paint a picture for us through his literary work. As we read this play, we can almost feel as if we are there with the characters. We are able to learn how they dealt with obstacles when segregation was still happening and what they did to overcome those obstacles. Without Wilson’s literary work, we would not be able to acquire the knowledge and understanding from the past. Literature allows us to be able to evaluate characters. We can analyze the character analytically and with an open mind. The more we are exposed literary works, the more we are able to omit the obvious in characters. We are able to create our own thoughts about them and use our critical thinking skills to connect with them on a more in depth level. A perfe... ...d dive into our imaginations allowing us to have a pleasant break from our everyday routine. Literature is often our sanity in a busy, hectic life. How about a good thriller or mystery? These works are exciting because we find ourselves playing detective and involved in situations we normally wouldn’t be immersed in. A good romance novel will keep that helpless romantic hopeful and full of joy believing in a life of love and happiness. It is important to expose children to literature. Their minds are vessels filling with information and expanding with knowledge every day. It’s important they read about history to learn where they came from. No matter how young our old we can all benefit from literature and even become kinder, smarter and happier beings. In short, Literature is an expression of individual thoughts and feelings achieved through our unique creativity.

This is a genetically engineered process by humans, in which, perfectly generated genes from someone or something is copied into its own life form to be an exact replica. In the article â€Å"Calves cloned to produce drugs† there are two cows involved with cloning. People should not be tampering with this, but letting God create people and animals the way he has it planned out to be. Not to mention, no two or more life forms should ever be exactly alike with the exact same genes (except for plants who are that way anyhow). With this happening to animals now and evolving toward humans, it could cause some huge problems with our world. It is acceptable for scientists and doctors to study genetic engineering and cloning, but not perform it physically in any kind of life forms.   Ã‚  Ã‚  Ã‚  Ã‚  The news article, â€Å"Calves cloned to produce drugs† in USA Today, is about two genetically engineered and cloned cows that are formed to produce new drugs. This cloning is from two sheep cloned for drugs and evolved into trying it on cows to produce a milk that will sustain blood pressure. More often than not, reaching that level of flawlessness requires great sacrifice. â€Å"The Black Swan†, directed by Darren Aronfsky, is a captivating psychological thriller set in the world of New York City ballet. The Movie received high ratings and Natalie Portman, who played the lead role of Nina, received praise for performing a majority of the dance scenes herself without much help from a stunt double.The real controversy comes a week after the movie is available on DVD when Portman’s stunt double, Sarah Lane, claims that it was actually she who did the majority of the dancing. According to Lane, Portman’s dramatic transformation into a ballerina – a story firmly at the center of her successful Oscar campaign- was not as impressive as the public was led to believe. â€Å" I mean, from a professional dancer’s standpoint, she doesn’t look like a professional ballet dancer at all and she can’t dance in pointe shoe. And she cannot move her body; she’s very stiff,† says Lane. Katrandjian) She claims that they [the directors and producers] only wanted for Portman to win an Oscar, and that’s their reason for falsely claiming that Portman danced. Otherwise it would not have been that effective of a movie. Others claim that it is not the dancing that won Portman an Oscar, but the way she portrayed an innocent, fragile, and sheltered adult-child who morphs into something perfect and unrecognizable at a fatale expense. â€Å"Black Swan† stars Natalie Portman as Nina Seyers, a featured dancer who is casted as the Swan Queen in the production â€Å"Swan Lake†.Nina is a quiet girl with an innocent demeanor, but also has hallucinations which are why her mother keeps her confined. She strives for perfection, but in order to get the part as the swan queen, she must show herself capable of playing the black swan. The black swan part requires her to not only â€Å"losing herself† but to be â€Å"seductive† in the dance. The audience is able to see the transformation of Nina throughout the movie. Nina’s life is a parallel to the production in which she is dancing. She is pure like the white swan, but later transforms into the polar opposite.She becomes the black swan towards the end of the movie and achieves perfection but only in death. Nina has a thirst for perfection, and it is this thirst that takes her to the edge and ultimately out of her innocence and into adulthood. Jen Chaney, a publisher for the Washington Post, noted â€Å"What impressed me the most about Portman’s work in â€Å"Black Swan†- and, I, suspect, most critics and Oscar voters- was the way she convincingly portrayed a fragile young woman descending into madness. The dance part of it nev er factored into my assessment of her performance†¦Ã¢â‚¬  (Chaney).Elizabeth Vargas, an anchor on Good Morning America, hosted an interview with Sarah Lane and others concerning the controversy. Vargas asked Jess Cagle, managing editor of entertainment weekly, â€Å"Do you think that any of the people that voted for Natalie for best actor for the Oscars would not have voted for her had they known that she didn’t do all the dancing for the movie? † Cagle replied â€Å"I can guarantee that it would definitely hurt Natalie Portman, and there was a lot of great dancing that Sarah Lane did that enhanced this performance and helped Portman win an Oscar. The way that a stunt double works is that the director would cast someone of similar height and weight and they would dance in that scene, and later they would digitally graft the face of the actor/actress onto the body. Portman’s face was superimposed onto Lanes body through special effects called â €Å"face replacement† in crucial dance scenes to make it appear as if it were Portman performing the sophisticated moves. The stunt double signs a contract that explains that she might not be featured in the credits. I am unable to say if Lane completely understood the contract.It is possible that lane is unfamiliar with the film industry but slandering the film and actors in it could prevent her from ever being casted as a stunt double in any future major films. It was unprofessional and Lane was told when casted that she wouldn’t receive out right credit. Others feel differently, they feel that Lane should defend the honor and hard work that dancers put into their line of work. Nikol Klein, a professional Ballet dancer, coach, and blogger wrote on her website â€Å"Whoever did the dancing in the movie is not the reason it won anOscar. I understand {as a dancer] that some in the dance community feel that Natalie Portman won the Oscar for her â€Å"Upper Body† portrayal of a dancer, but if you truly watch the film you will see that it is far more than that. Natalie Portman received a much deserved Oscar for her work as an Actress, not as a dancer. In fact, if you watch the movie again you will see that there really isn’t much dancing in the movie at all. Has Lane seen the movie? So why the controversy? One thing that we dancers have is pride.Our profession feeds off of acknowledgement and acceptance. † A lot of what Lane is upset about is how she feels that Portman is claiming that you can become a ballerina in a year in a half. Although this is untrue and was never stated by Portman, actors and actresses do go through intense training for their part. For example, the movie â€Å"Walk the Line†, a film about the life and career about Johnny Cash, Reese Witherspoon actually had to learn to sing like June Carter Cash. Oscars like these are often handed out for full artist transformations.It is part of what acting involve s, which is why the audience saw Reese Witherspoon win an Oscar for â€Å"Walk the Line†. Anytime an actor can mold them into something they’re not, real talent is shown and Oscars are given. It’s been done time and time again. It has been said repeatedly that if Natalie had been honest about her lack of actual dancing, she probably would not have won. When did she ever lie though? In countless interviews I watched, Natalie has always acknowledged the fact that there was indeed a stunt double; they all had one. Needless to say, it was about the transformation that took place.Portman spent year and a half training for this part and had lost a significant amount of weight in order to show the actuality of a ballerina. Lanes statement were followed by a rebuttal in a March 23 2011 L. A Times article in which Portman’s then fiance (now husband), and Black Swan dance choreographer, Benjamin Millepied said Lane’s work in the film was far less significant . â€Å"There are articles now talking about her dance double that are making it sound like [lane] did a lot of the work, but really, she just did the footwork, and the fouett? , and one diagonal [phrase] in the studio,† he said, â€Å"honestly, 85% of that movie is Natalie. † â€Å"Black Swan† editor Andy Weisblum agreed to take a closer look for â€Å"20/20. † â€Å"There are about 35 shots that are full body shots in the movie. Of those 35 shots, 12 are Natalie, and then the rest are Sarah,† Weisblum said. â€Å"But over the overall film, Natalie did a lot more than that. I mean, she did most of the other shots. It was sometimes hard for me to tell the difference as the editor, it was so close. † (Zakarin).As I researched the background history, I came across this statement from Darren Aronofsky, â€Å"Here is the reality; I had my editor count the shots. There are 139 dance shots in the film – 111 are Natalie Portman untouched,â €  he said â€Å"28 are her dance double Sarah Lane. If you do the math, that’s 80% Natalie Portman. † (Zakarin). The point is this movie is one hour and 48 minutes long. Regardless of how many shots were of Lane or Portman, we all know for a fact that 100% of the acting was Portman which Is what makes â€Å"Black Swan† an Oscar winner.

As our country is an under develop country, the banks play the role of an intermediary and can mobilize the excess fund of surplus sectors to provide necessary finance, to those sectors, which are needed to promote the sound development of the country. The banks provide different types of services to its counter parts, like general banking services or finance or investing which results transaction of currency. To do this they also need capital, assets and other factors which effects directly in the bank performance. This report will help to understand the customer satisfaction on the services of MBL. As a result, we can have a clear idea about customer satisfaction on the Services of MBL. 1.3 Scope of the Report: MBL is always trying to improve their customer service in every sector, but in today’s competitive business world, banks need to give additional concentration to the client’s requirements, in order to stay at the top. Here average time was 20 minute for every respondent. There are 20 questions on the questioner. Question type was close ended. 1.5.5 Sampling Plan: 1.5.5.1 Target Population: All clients of MBL Gulshan branch in Dhaka city. 1.5.5.2 Sampling Element: Individual clients of MBL . 1.5.5.3 Sampling Frame: No well structured sample frame was found. 1.5.5.4 Sampling Procedure: Non probability convenience sampling procedure is used. 1.5.5.5 Sample Size: I have taken 50 customers as my sample. 1.5.6 Data analysis and reporting: Quantitative and qualitative data collected and analyzed according to acceptable standards of practice. Here most of the respondents have Monthly saving scheme (MSS) Here bank should give importance on other accounts. (2) Why you choose mercantile bank? Or reason of choosing this Bank? FIG: 5 From the graph, it is seen that the 11 respondents choose this bank for the number of branches of the bank, 15 for location of the bank, 3 for reputation of the bank, 16 for service of the bank, 5 for personal relationship. Here most of the respondents choose this bank because of the service and location of the bank. (3) What are the services of this bank you usually use? FIG: 6 From the graph, we found that the 20 respondents use MSS of this bank, 3 uses LC of the bank, 9 uses current account of the bank, 7 uses FDR of the bank, 7 uses Card & 4 uses locker service of the bank. Here most of the respondents use MSS and current account services of the bank. (4) Are you satisfied with the service charges of the bank? FIG: 7 From the graph, we can see that the 25 respondents said moderate, 14 respondents said service charges are high, and 11 respondents said the service charges are low from some other banks. (5) Are you satisfied with the account opening procedure? FIG: 8 From the graph, we can see that the 23 respondents are satisfied with the account opening procedure, 12 are very satisfied and 15 are dissatisfied. Here most of the customers are satisfied with the account opening procedure. (6) Are you a debit card holder of this Bank? FIG: 9 From the graph, it is seen that the 14 respondents are card holder and 36 respondents are not. Here the respondents who have account in the bank they can apply for the card. (7) Do you think the numbers of ATM booths are sufficient? FIG: 10 From the graph, it is seen that the 76% respondents think that the numbers of ATM booths are not enough and available, 24% respondents think that the numbers of ATM booths are sufficient. So, most of the respondents are not satisfied with the number of ATM booths. (8) Do you think MBL takes longer time to issue a card? FIG: 11 From the graph, we can see that 20 respondents think they don’t take longer time to issue a card, 20 respondents think they take a longer time & 10 respondents think they take a very long time. FIG: 12 From the graph, it is seen that the 17 of the respondents are satisfied with the ATM services, 20 respondents are dissatisfied, and 13 respondents are in moderate position. FIG: 17 From the graph, we can see that 5 respondents are highly satisfied on the work of employees of MBL.15 respondents are satisfied & 26 respondents are in neutral position & 4 respondents are dissatisfy. FIG: 18 From the graph ,we found that 0% respondents are highly satisfied with the lone processing ,28% respondents are satisfy with it, 24% respondents are in neutral position ,48% are dissatisfy on the lone taking process. Part-5 Major Findings Major Findings: Mercantile Bank Ltd actively participate in the growth and expansion of the national economy by providing various kind of services. While analyzing the policies and procedures & analyzing the customer satisfaction of the Bank the following areas were mostly viewable. * Most of the respondents have MSS account. * Most of the respondents choose this bank because of the branch location & services of the bank. * Most of the respondents come to this bank for the MSS, FDR & savings accounts. * Most of the respondents are satisfied with the MBL charges. * Most of the respondents are satisfied with the account opening procedure of the bank ,but respondents had to face some difficulties to open current account because it require introducer who already have current account on MBL. * Most of the respondents don’t use card of this bank. * Most of the respondents are not satisfied with the number of ATM booths. * Most of the respondents are not satisfied with the system of issuing a card. * Most of the respondents are not satisfy with the ATM services. * Most of the respondents are satisfied with the branch location. * Most of the respondents know about the bank from friends & family. * Most of the respondents are satisfied with the MBL interest rate. * Most of the respondents are not satisfied with the promotional actives of the bank. * Most the respondents are satisfied with the MBL employee’s attitude and behavior because they can expertly solve the banking problem. * Most of the respondents think the loan processing system is not easy & high interest rate on personal loan. Part-6 Recommendation Recommendation: MBL has an efficient and excellent management team and performing with a great expertise and care. The limitations can be overcome by some measures to make the performance outstanding. I have some suggestions for The MBL according to my observations out of my survey on 50 customers. Those are given below: * The bank should offer more facilities on other account to attract more customers. * The bank should build a strong image on market through covering new area. * The bank should provide more attractive features & plan to attract more customers. * Customers are satisfied with MBL charges, so the bank should attract large number of customer through using this low cost strategy. * The customers are satisfied with the account opening procedure of the bank. But the bank should introduce an easier process to open current account. * The bank should provide more facilities in the ATM cards. * They should increase the number of ATM booth because the Customers are not satisfied with the number of it. * The bank should give more importance on the system of issuing a card as early as possible. * The bank should give more concentration on the ATM services because the customers are not satisfied with it. * The bank should find new important area to make new branches & search opportunity for the bank. * The bank should increase their advertisements. * The bank’s customer are happy with the interest rate, through this advantage the bank should attract more customers. * The bank should increase the promotional actives on TV, print media & radio. * The bank has many efficient employees an efficient employee can attract the customers, so the bank should give more importance on that. * The bank should introduce an easier process for giving lone. Part-7 Conclusion Conclusion: Mercantile Bank Limited is a strong and effective player in the financial system. It is a solid, forward-looking, modern local bank with a record of sound performance. It is a new generation bank. It is committed to provide high quality financial services /products to contribute to the growth of GDP of the industrialization, boosting up export, creating employment opportunity for the educated youth, rising standard of living of limited income group and overall sustainable socio-economic development of the country. The bank has the vision to be the best Private Commercial Bank in Bangladesh in terms of efficiency, capital adequacy, asset quality, sound management etc. it is now one of the top most profitable commercial bank. As concluding remark the bank is able to attain a leading role with the 13 years success story but to remain in Strong position among new generation banks, the bank must face new challenges. The bank must make a positive attempt to be more outward looking in their goals and aware of what is happening. They must also emphasize on the domestic scenario more closely and analyze any certain trends and strategies of their competitors.
